The barrier heights are the same either side. The paperwork behind a dividing fence and a pool certificate is not. Most companies advertising down here write everything to the Queensland rules anyway.

Your dividing fence in Tweed is under NSW law, not Queensland’s

This is the part that trips people up when they get a quote from a Gold Coast mob.

In New South Wales the Dividing Fences Act 1991 applies. You and your neighbour split the cost of a sufficient dividing fence equally — half each, whether it’s a new fence, a replacement or a repair. “Sufficient” means it does the job for the area, not the most expensive option on the market. A standard Colorbond boundary clears that bar in most streets.

If you want your neighbour to pay their half, you serve them a Fencing Notice setting out the work and the cost. From the day it’s served, they have a month to agree or come back with something else. If you can’t reach agreement after that month, either of you can go to a Community Justice Centre for mediation, or apply to the Local Court or NCAT for a fencing order.

Queensland runs a different act with different forms. If you’ve moved down from the Gold Coast, don’t assume the process carries over.

We’re not lawyers and we won’t pretend to be. But we quote in a way that makes the notice easy — an itemised written quote you can hand straight to the neighbour, so the split is clear and nobody argues about the number.

Pool fencing in Tweed: same barrier, different paperwork

The physical barrier is the one thing that doesn’t change at the border. Both states build to AS 1926.1-2012:

• at least 1.2m high, measured from finished ground level
• no gap at the bottom over 100mm
• a 900mm non-climbable zone on the outside of the barrier, all the way around

The certification is where NSW splits off. Your pool has to be listed on the NSW Swimming Pool Register. A Certificate of Compliance is issued by your council or an accredited private inspector after an inspection. It stays valid for three years as long as you haven’t changed the barrier.

You’ll need it at two moments. Selling — the contract has to carry the register certificate plus either a valid compliance certificate, an occupation certificate issued in the last three years, or a non-compliance certificate. Get that wrong and the buyer can rescind within 14 days. Leasing — landlords have to give the tenant a compliance or occupation certificate, and a non-compliance certificate won’t do for a rental.

None of that is the Queensland Form 23 process. If someone quoting your Tweed pool fence is talking about pool safety certificates and Form 23, they’re quoting you Queensland.
